Special Town Meeting, December 9th, 2007

Meeting Called to order 1:40PM
Article 1: To choose a moderator to preside at said meeting.
Opened floor for nominations for moderator.
Herb Maine nominated Jerald Wiles. Vivian Boxer seconded.
Asked if any more nominations, seeing and hearing none, Donna Damon motioned to close nominations. Mark Dyer seconded.
Three citizens came forward to vote by ballot. The results were unanimous electing Mr. Wiles as Moderator for the meeting.
Town Clerk Susan Campbell swore in Jerald Wiles as moderator.
Jerald Wiles noted that he would be following the Maine Municipal Moderators Guide Lines Manual.
At this point Jerald Wiles recognized Donna Damon. Donna Damon introduced the visitors from Russia and also Nancy Carter from the Island Institute. Our visitors made presentations to the Historical Society and Town.
Jerald Wiles explained why we were holding this meeting as we are 180 days into our being a new town and the July 1, 2007 Town Meeting voted that we would do so.
Article 2: To vote whether to continue, as form of Government: and on an interim basis and by no later than the 2008 Annual Town Meeting, certain Cumberland ordinances listed below, and to accept appropriate fees and other payments or receipts generated by such ordinances:
· Dog Control Ordinance,
· All Terrain Vehicle Trespass Ordinance,
· Solid Fuel Safety Ordinance,
· Public Swimming Pool Ordinance,
· Dance Hall Ordinance,
· Special Amusement Ordinance,
· Victualers License Ordinance, PAGE 2
· Licenses and Permits Ordinance, and
· Solid Waste Facility Ordinance.
References therein to the Town Of Cumberland shall mean, as appropriate, the Town of Chebeague Island, and references to the Town Council or Council shall mean the Board of Selectmen, except in reference to amendments of the ordinance, which authority is reserved to Town Meeting. These ordinances shall remain in effect until replaced by the adoption of revised ordinances at the Annual Town Meeting of 2008.

Asked for motion to approve article as written. John Ash moved to approve. Beth Howe seconded. Donna Damon advised that the ordinances were not ready due to not enough time to really do a good job.
The moderator recognized David Hill who asked for clarification of the sentence reserving authority to amend ordinances to town meeting. The moderator recognized Beth Howe who explained that the ordinances had language that recognized the authority of Cumberland Councilors to amend ordinance s and the language in this article makes it clear that passing this article does not grant that authority to the Board of Selectmen of Chebeague.
Vote: Unanimous.
Article 3: To
vote whether to accept the transfer from the Cumberland Cemetery Association
of $41,700 to the Town of Chebeague, plus interest earned, for the care and
maintenance of the Chebeague Island Cemetery, said funds being comprised of
$10,000 from the McCall Fund, so-called, $31,700 from individual perpetual care
contributions, and any and all interest accrued on the monies to the date of
transfer.
By acceptance of these funds, the Town of Chebeague Island further releases the
Town of Cumberland and the Cumberland Cemetery Association from any further
responsibility in regard to the maintenance of said Chebeague Island Cemetery
and
the management of these funds, and agrees to hold harmless and defend the Town
of Cumberland and the Association with respect to any claims made regarding the
care of the cemetery or the management of funds arising from events occurring
after the transfer of these monies.
Jerald Wiles read Article 3 and opened floor to discussion, seeing and hearing none asked for motion to approve article as written. Deborah Bowman moved to approve. John Ash seconded. Beth Howe asked for ³after² be added to the last sentence. Deborah Bowman moved to amend her motion to include this change in wording which amendment the moderator allowed after asking for unanimous consent.
Discussion: Pommy Hatfield asked what kind of an account that the monies would be put in and if we know what kind of interest it would draw. Dianne Calder advised that last she thought it was drawing 4 to 5% percent in a CD. Donna Damon advised that the State limits the kind of investments that can be made with public funds. Pommy Hatfield also asked how the money will be used and how will the cemetery get it.

Donna Damon advised that the committee will come to the Selectmen to approve any expenditures. Herb Maine said that the Selectmen had discussed the need to track the money in a separate town account, but that they had not discussed how to invest the money or how to track or use the interest it would earn. David Hill advised that the bank is able to set up sub-accounts to track things like this. Leon Hamilton reminded everyone that this was to approve the transfer of the funds and not how they were to be used. Dianne Calder advised that this was left off the July 2007 warrant in error and thatıs why we need to approve it at this meeting. She also advised that this is perpetual care money and has restrictions on it. Jerald Wiles asked for further discussion seeing and hearing none asked for a vote.
VOTE: Unanimous.
