THIS AGREEMENT MADE this 8th day of April, 1997 by and between School Administrative District NO. 51, through its Board of Directors, and Chebeague Transportation Company (CTC)
NOW THEREFORE, the parties agree as follows:
1. The current discounted round trip adult fare charged by CTC is $4.80 per passenger; the current discounted round trip childrens fare charged by CTC is $1.50 per passenger.
2. The current cost for a regular parking spot in CTC's Blanchard parking lot on Cousins Island is $250.00 per year; a transferrable space is $300.00.
3. During the period from September 1, 1997 to June 30, 1998, Chebeague Transportation Company will:
(a) Convey registered students residing on Chebeague Island in the Town of Cumberland to Cousins Island in the Town of Yarmouth for the purpose of enabling such students to attend public schools on the mainland in Cumberland on each school day during said period (usually 180 days).
(b) Convey the S.A.D. #51 Board of Directors and other personnel to and from the Island for Board meetings at a rate equal to the current discounted round trip fare per person. (A maximum of two meetings per year are included in the contract cost).
(c) Convey at no additional charge any school director who resides on Chebeague Island on a regularly scheduled run for the purpose of attending S.A.D. #51 Board meetings (maximum of 40 per year)
(d) Convey at no additional charge regular employees of S.A.D. #51 between Chebeague and Cousins Island when performing services for the District between 7:00 am Monday through 6:30 pm Friday during the regular school year, providing they utilize a trip listed on the Company's printed schedule. (In support of its monthly invoicing, CTC will compile a listing of employees not traveling under this contract provision and submit such listings to S.A.D. #51 for payment. If S.A.D. #51 schedules special trips, CTC will invoice S.A.D. #51 for the cost of such trips). S.A.D. #51 agrees to provide CTC with a list of names and positions of regular employees traveling under the provisions of this contract at the beginning of the school year and will provide updates when changes occur.
(e) Convey at no additional charge school volunteers to or from Chebeague (maximum: 75 round trips).
(f) Permit S.A.D. #51 to arrange up to twenty (20) field trips (including six (6) trips for swimming instruction) from Chebeague at no additional charge for the Island school pupils, teachers, and chaperons during the normal school year on trips listed on the Company's printed schedule. The cost of special trips, if requested, will be billed to S.A.D. #51.
(g) Permit S.A.D. #51 to arrange up to twenty (20) field trips to Chebeague at no additional charge for the mainland school pupils, teachers, and chaperons during the normal school year on trips listed on the Company's printed schedule. The cost of special trips, if requested, will be billed to S.A.D. #51.
(h) Allow other field trips for Cumberland students to be arranged at the current discounted adult fare for those aged 12 and above.
(i) Permit pupils in grades 7-12 to travel on any trips listed on the Company's printed schedule in order to permit them to stay after school for extra help or for extra curricular and sanctioned activities so long as each student travels no more than one round trip on CTC vessels per school day. The student shall provide the Company with a one-time note indicating participation in an activity and the duration of the participation.
(j) Provide an extra round trip to and from Chebeague for students who would be otherwise unsupervised between the hours of 2:30 pm and 5:30 pm when school events are scheduled after 5:30 pm.
(k) Provide an additional boat at no cost to the pupils a maximum of twelve (12) times a year to enable Chebeague pupils (K-12) to attend school functions. This provision is subject to district notification to CTC forty-eight (48) hours in advance of said school functions.
(l) Will issue two (2) permanent and four (4) transferrable parking permits to S.A.D. #51
for the use of up to six (6) different vehicles during weekdays of the normal school
year. The permanent permits will specify the vehicle registration permitted to use the
parking facilities at Cousins Island. Transferrable parking permits must be placed on
the dashboard of the vehicle where visible to the parking lot attendant. All S.A.D.
#51 users (other than the permanent users) will be issued numbered dashboard
identification placards; if more than six vehicles, as identified by permit or placards,
use the parking facilities on any occasion, extra vehicles will be billed at the current
daily rate. With no more than six vehicles in the lot on a given day, no daily parking
charge will be made to S.A.D. #51. Other parking charges will be made at the
Company's regular rates and invoiced to S.A.D. #51 monthly, along with an
accounting of the vehicles in the lot during "overflow" days.
4. Conveyance shall be aboard the Islander or Big Squaw, or their equal. CTC shall keep said
vessels in safe and seaworthy conditions during the term of this agreement and shall comply
with all appropriate United States Coast Guard regulations and requirements. The owner of
the vessel should carry $500,000 to $1,000,000 P. & I. insurance on the boat and provide the
District with a certificate from their insurance company.
5. Except when otherwise directed by the Superintendent of Schools or by his or her
representative, departure from Chebeague Island shall be approximately 6:40 am and
departures from Cousins Island shall be approximately 2:30 pm except Wednesdays when
departure shall be approximately 1:40 pm. The early boat on Wednesdays is only for those
days that involve early dismissal.
6. Nothing herein contained shall require the CTC to make any trip at a time when, in the
Captain's opinion, it would jeopardize the safety of such students to do so.
7. For services rendered under the terms of this agreement, the District shall pay CTC an annual
sum of $29,520 payable in two equal installments ($14,760) on September 30 and December
30 of this year. It is further agreed that the student enrollment as determined on September
30 of this year will serve as the basis for payment and that no additional adjustments will be
made for the school term covered by this contract.
8. Whenever possible and practical, departures and arrivals at Chebeague Island shall be made
at the Stone Wharf, so called, and whenever possible or practical departures and arrivals at
Cousins Island shall be made at the Cousins Island Landing, so called. Whenever use of these
landings is impossible or impractical, CTC shall use such other landings on Chebeague Island
and/or Cousins Island and/or the mainland as may be deemed advisable, unless the
Superintendent shall expressly disapprove such substitute landing or landings, on grounds of
safety or other good cause.
9. Chebeague Transportation Company's obligation under this agreement shall not be assignable
in whole or in part without the express approval of S.A.D. #51 Board of Directors.
10. In the event of questions regarding interpretation of this agreement, interested parties will be
directed to S.A.D. #51's Director of Finance, Human Resources, and Operations or to CTC's
Administrative Director.
11. This agreement shall be terminated by mutual consent of the parties at any time. This agreement may also be terminated by either of the parties as of the end of any school year covered by this agreement by giving to the other party written notice of such desire to terminate at least ninety (90) days prior to the end of the school year.
